Gikumpirmar sa National Labor and Relations Commission (NLRC) ang unang hukom sa Labor Arbiter (LA) pabor sa delivery riders sa FoodPanda Philippines nga gi-terminate niadtong 2021.
Sa usa ka desisyon nga gipagawas niadtong Disyembre 7, 2022, ang NLRC 8th Division mimatuod sa hukom sa LA nga ang mga delivery rider nga ningsang-at og reklamo nga illegal dismissal batok sa FoodPanda Philippines, Inc. mao ang mga regular nga empleyado sa naulahi, ug giingon nga ang mga rider ilegal nga gitangtang sa trabaho.
Ang desisyon sa NLRC nag-ingon nga adunay relasyon sa amo ug empleyado tali sa FoodPanda ug sa delivery riders tungod kay “the power of control was clearly wielded by [Food Panda] through extensive supervision from start of their assigned duty until it ends, the company’s actual prohibition of alternative employment and its algorithmic disciplinary measures indicate strict supervision and control over its delivery riders.”
Niingon usab sa Komisyon nga ang aksyon sa Food Panda sa pagsuspenso sa mga nangreklamo sulod sa 10 ka tuig katumbas sa constructive dismissal, busa ang riders ilegal nga gitangtang.
Kahinumdoman nga ang mga reklamante maoy delivery rider sa FoodPanda apan kalit lang gibalibaran ang pag-access sa rider application sa Foodpanda nunot sa gipangayo sa maong mga rider alang sa transparency kalabot sa kwentada sa ilang suholan ug katugbang nga mga deduction.
Ang mga reklamante ningpasaka og kasong illegal dismissal atubangan sa NLRC. Matod sa desisyon, gibaliwa sa FoodPanda ang employer-employee nga relasyon ug nangatarungan nga ang nahisgutang mga rider independent contractors.
Niadtong Hunyo 2022, ang LA nagpagula og desisyon nga nagdeklarar sa mga nangreklamo isip mga regular nga empleyado ug naghukom nga ang FoodPanda adunay tulubagon sa ilegal nga pagpaundang sa trabaho sa mga nagreklamo.
“In the still raging war against [Covid-19], we take judicial notice of the fact that food delivery riders have repeatedly been alluded to as frontliners and heroes for enabling us to abide by physical distancing and other health protocols, while, at the same time, bolstering the economy,” nisuwat ang NLRC sa iyang 19-ka pahina nga decision.
Ang Komisyon midugang, “Nevertheless, while they have been hailed as heroes, they have not always been treated as such. As heroes, they should, at the very least, be able to demand minimum labor standard benefits, e.g. minimum wage, service incentive leave, right to organize and collective bargaining, and security of tenure provided under Philippine laws.”
