Truck driver sued for Talisay road accident

THE family and boyfriend of the person who died in a road accident in Cebu South Coastal Road in Barangay San Roque, Talisay City have filed a case against the truck driver.

Marilou Hermosa, 24, of Mandaue City, died after she was run over by a prime mover driven by Michael Brobo, 45, who hails from Barangay Pitogo, Consolacion town, northern Cebu, last January 21.

Hermosa was riding a motorcycle driven by his boyfriend Roy Aribias, 27, a resident of Campo 8, Toledo City, when they were hit by the truck.

According to City of Talisay-Traffic Operations and Development Authority (CT-TODA) head Jonathan Tumulak, the incident was the second to happen this year.

Tumulak said Brobo and Aribias were both running in the same direction toward Cebu City when upon reaching Barangay San Roque, the former changed lane, hitting the latter in the outer lane, which was designed for motorcycles.

Both Hermosa and Aribias fell off the motorcycle and were run over by the truck.

Hermosa was brought to the hospital, where she was declared dead on arrival.

Aribias survived the accident.

"Dili una ta maka determine kon kinsa ang sad-an apan basin sa among nakita, ang kadtong maong truck didto niagi sa outer lane. Kanang outer lane is para na sa slow moving vehicle, so kana lang siguro ang among ika sulti sa pagkakaron. Adto nalang siguro nato itugyan sa korte," Tumulak said.

(We could not yet determine who was at fault but based on our observation, the truck was in the outer lane, which is designed for slow-moving vehicles. That’s what we could say as of now...it’s up to the court to decide.)

He added that both parties have not settled the case during the investigation, prompting the family of the victim to file charges for reckless imprudence resulting in homicide and physical injury against Brobo. (BBT/TPT)
