Ang Pryce Corporation Inc., usa ka kompaniya nga namaligya og mga memorial lots ug nagtanyag og interment services, mipasaka sa usa ka special civil action for declaratory relief sa Regional Trail Court (RTC) Branch 17 sa Cagayan de Oro City.
Gibarugan sa maong kompaniya nga ang interment service sa namatay nga usa ka senior citizen wa malakip sa mga serbisyo nga hatagan og diskuwento nga 20 porsiyento ubos sa Republic Act (RA) No. 7432, ang Senior Citizens Act.
Nihukom ang RTC pabor sa kompaniya. Matod pa sa RTC ang implementing rules and regulations (IRR) sa RA 9994, ang Expanded Senior Citizens Act of 2010 nga nag-amendar sa RA 7432, naghisgot lang sa pagpalit sa lungon o urna, pag-embalsamar, pagbutang sa morgue ug paghatod sa patay nga lawas ngadto sa lubnganan.
Nag-ingon ang RTC nga ang diskuwento wa maglakip sa serbisyo sa paglubong sama sa pagkawot sa yuta nga lubnganan sa namatay, pagsemento sa lubnganan ug sa uban pang mga serbisyo sa paglubong sa namatay.
Mipasaka og petition for review sa maong kaso ngadto sa Korte Suprema ang Office of the Solicitor General, ang Office of the Senior Citizens Affairs ug Department of Social Welfare and Development. Gidapigan sila sa Korte Suprema en banc.
Ang desisyon nga sinulat ni Associate Justice Rodil Zalameda, misalindot sa hukom sa RTC. Matod pa sa Labaw’ng Hukmanan, wa kini sa balaod ug sa IRR niini. Ug nga ang usa ka IRR di makaamendar sa usa ka balaod kay usa lamang kini ka lagda.
Matod pa niini, “a law cannot be amended by a mere regulation, and the administrative agency issuing the regulation may not enlarge, alter, or restrict the provisions of the law it administers.”
Matod pa niini ang Senior Citizens Act usa ka balaod nga gipanday “to grant a bundle of benefits in favor of senior citizens or those at least 60 years old, giving flesh to the declared policy of motivating senior citizens to contribute to nation building and encouraging their families and communities to reaffirm the Filipino tradition of caring for the senior citizens.”
“Death may be the end of one’s life. But from the perspective of those left behind, there are things that survive a person’s demise. For the romantics, it is the memories and feelings that linger long after the passing of a loved one.
