Gisuspenso sa Regional Trial Court sa dakbayan sa Sugbo si Florida P. Nuñez, acting chief sa Cebu 5th District Engineering Office sa Dept. of Public Works and Highways (DPWH), tungod sa giingong paglapas sa section 3(e) sa Republic Act 3019 o ang Anti-Graft and Corrupt Practices Act.
Kini human gipasaka sa prosekusyon ang Motion to Suspend Accused Pendente Lite batok sa upat ka mga opisyal sa gobiyerno nga gilambigit sa kasong graft and corruption.
Si Florida P. Nuñez, uban nila ni Rogelio N. Quibilan, Stephen Eric G. Castrodes, ug Violeta Orbeta gimanduan nga “immediately cease and desist from performing the functions of their respective offices upon the implementation of this Order of Preventive Suspension.” (diha-diha dayon mohunong ug di na mobuhat sa mga katungdanan sa ilang tagsa-tagsa ka mga buhatan sa pagpatuman niining Order of Preventive Suspension.)
Opisyal nga gipasaka sa Cebu City Prosecutor’s Office ang kaso niadtong Septiyembre 2022 batok sa mga akusado, dihang ang mga opisyal giingong nagkunsabo “with deliberate intent and acting with manifest impartiality” sa pagdeklarar sa P.B. Obial Construction nga post-disqualified gikan sa lima ka mga proyekto sa gobyerno bisan pa kon gideklarar nga adunay labing ubos nga bid.
Gisang-at sa PB Obial Construction ang reklamong kriminal niadtong Hunyo 2022 batok kang Nuñez ug laing lima ka mga opisyal ug mga miyembro sa bids and awards committee.
Ang kamandoan sa RTC nag-ingon nga ubos sa Anti-Graft and Corrupt Practices Law, “the suspension of a public officer is mandatory after a determination has been made of the validity of the Information.” (Ang pagsuspinde sa usa ka opisyal sa publiko mandatory human sa usa ka determinasyon nga gihimo sa balido nga impormasyon.)
Si Nuñez ug ang tulo pa ka nahisgutan sa kamandoan gisuspenso sa serbisyo nga wala’y sweldo, samtang naghulat sa resolusyon sa kaso subay sa seksyon 13 sa RA 3019.
Si Nuñez misang-at og pagsupak sa mosyon sa pagsuspenso, apan ang korte nihukom nga “the information charges all the accused with violation of section 3(e) of RA 3019,” nakakita nga ang kaso naglambigit og criminal prosecution.
