Mayor terminates services of housing contractor

ILOILO City Mayor Jed Patrick Mabilog signed on Thursday a Notice of Termination of Contract to Ace Builder and Enterprise, contractor of the P130-million housing project.

The notice dated August 23, 2010 will be delivered personally by a team of lawyers headed by city legal officer Jose Junio Jacela to proprietor Alexander R. Trinidad of Ace Builder whose last known office address is at Suite D.K. Condominium, Vicente Lim St., Ortigas Center, Pasig City in Metro Manila.

Mabilog said the lawyers may leave soon in the morning and be back in the afternoon.

The termination is effective 30 days from receipt and upon termination, a joint inventory and evaluation of the housing project will be conducted by the city pursuant to provisions of the rules and regulations governing the implementation of infrastructure project in Iloilo City.

Mabilog said Ace Builder is allowed to send a representative to send and participate in the inventory on or before October 10, 2010. Failure of the contractor or his representative to appear shall be deemed a waiver of whatever rights under the contract.

The city chief executive said that the City Government is poised to take over the housing project located at Barangay Ungka, Pavia, Iloilo and may continue or sell the unfinished project to any interested party.

The project was abandoned by the contractor in 2003 after complaints had been raised defining substantial defects and the use of substandard materials.

The contractor was also found for non-compliance with the plan and deviations of actual work plan from the approved plans and specification, unreasonable suspension of work and failure, refusal and neglect to supply and provide the required tools, materials, supplies, equipment and facilities to complete the project since 2003.

Since then, the unfinished housing project was abandoned and almost all units were destroyed and vandalized. (Lydia C. Pendon)
