MANILA -- A member of the House prosecution panel said Tuesday the inclusion of a dead Agriculture official on the list of people Ombudsman Merceditas Gutirerrez ordered charged over the 2004 fertilizer fund scam, shows the order was rushed.

The Office of the Ombudsman charged former Department of Agriculture regional executive director for the Cagayan Valley Gumerindo Lasam with malversation Friday.

However, Bayan Muna party-list Representative Neri Colmenares said Lasam was killed in an ambush in April 2009.

Colmenares added this shows Gutierrez was not serious about running after the people behind the P728-million scam.

"Their defense that it took them years to investigate to be thorough is now shattered by this latest mistake. Ombudsman Gutierrez is not serious in filing the case. The once impregnable Ombudsman is now crumbling,” he said.

Aside from Lasam, the Ombudsman has ordered the filing of plunder charges against former Agriculture secretary Luis “Cito” Lorenzo Jr., former Agriculture undersecretary Jocelyn “Jocjoc” Bolante, and former Agriculture assistant secretary Ibarra Poliquit.

The delayed filing of cases is one of the bases for her impeachment case.

The House of Representatives impeached Gutierrez in March.
