Felonia files motion to suspend proceedings

DAVAO CITY -- Murder suspect Leonardo Felonia, former police regional intelligence unit head, has filed a motion asking a local court to suspend the proceedings until the Supreme Court has resolved his petition to transfer him to Manila.

Felonia, who is facing charges before the Regional Trial Court Branch 16 on accusations that he ordered the assassination of Cebuano businessman Richard Lim King, has filed a manifestation with urgent motion to suspend proceedings pending resolution of the petition to transfer venue by the Supreme Court.

Felonia has requested for the transfer of the trial to any RTC in Manila for fear of his life.

"It is most respectfully submitted that the resolution of the said petition would be pre-empted if the proceedings in the instant case will continue without the said petition having first been resolved," he said.

RTC Branch 16 Emmanuel Carpio has yet to resolve the motion as there is still another pending request this time from the Philippine National Police Intelligence Group (PNP-IG) in Manila that currently has the custody of Felonia.

Carpio has then set a hearing on April 10 to discuss the PNP-IG's request and the opposition of private prosecutor Deolito Alvarez.
