BI wants deportation

THE Bureau of Immigration (BI) will conduct summary deportation proceedings against the Taiwanese and Chinese nationals who were arrested by the police for their alleged involvement in online fraud.

BI Alien Control Officer Casimiro Madarang III said they have already recommended to their central office in Manila the summary deportation proceedings against the Taiwanese and People’s Republic of China (POC) nationals granting the police will not file charges against them.

However, Madarang said that if the police will file charges, they will still conduct deportation proceedings, but the result cannot be implemented while the case is pending.

He explained that in summary proceedings, the hearing will be rapid and the deportation will be conducted without delay.

Law

Under the immigration law, if a foreigner is facing criminal charges in court, the BI will wait for the termination of the case or the judgment of the case with finality, said Madarang.

If the court will convict the foreigner and sentence him to a prison term, the BI will wait until the foreigner can fully serve his jail punishment before the immigration authority can deport the erring alien.

Recommendation

Madarang said that immediately after the police told them that the Taiwanese and Chinese nationals were arrested for on-line fraud violation, they recommended to their central office the conduct of summary deportation.

“We are waiting for order of our immigration central office to conduct the summary deportation proceedings. If the order will arrive today, then the summary proceedings will start today,” Madarang said.

In the deportation proceedings, Madarang said they will determine the violation and collate the evidence against the foreigners.

“That is granting the police will not file the charges against these erring foreign nationals in court,” Madarang said.
