Prosecution opposes Ampatuan grandson’s request for medical check-up

THE prosecution panel of the Maguindanao massacre case on Friday opposed a motion requested by the grandson of former Maguindanao governor Andal Ampatuan Sr., allowing him to undergo a medical check-up outside his detention facility as he might use this to escape.

In a comment submitted by Senior Assistant State Prosecutor Ma. Emilia Victorio to Judge Jocelyn Solis-Reyes of the Quezon City Regional Trial Court (QCRTC) branch 221, the prosecution said the request of Datu Anwar Ampatuan lacked a medical certificate or abstract fully detailing his condition that would require his examination.

"There is no explanation why accused cannot be examined within the jail premises by government physicians as has been the request of the prosecution early on," the prosecution said.

The accused could not walk and remains immobile due to the swollen legs.

Through his legal counsel Emmanuel Brotarlo, Ampatuan sent his request to the court to allow him to undergo medical treatment at the Philippine General Hospital in Manila. He is currently detained in Camp Bagong Diwa in Bicutan, Taguig City.

The request stated that Ampatuan's current state can be traced to the injuries that he suffered after the explosion in Mamasapano, a town in Maguindanao sometime in March 2012.

The prosecution stressed that based on the observation of the doctors who attended to him, as early as September 2012, Ampatuan was already able to walk.

Members of the Ampatuan family are accused of masterminding the November 2010 massacre of 58 people, mostly media workers, and relatives of the clan's political opponent, Esmael Mangudadatu, the current governor of Maguindanao. (Sunnex)
