REGIONAL Trial Court Branch 16 Presiding Judge Emmanuel Carpio ordered to give the Davao City Police Office (DCPO) time to comment on the motion filed by murder suspect Leonardo Felonia, who was tagged in Cebu-based businessman Richard King’s death, Felonia's legal counsel told the media.
It was reported that lawyer Caesar Europa, the legal counsel for the accused Felonia, filed a motion for show cause order before the sala of RTC-Branch 16 in response to the non-compliance of the DCPO to an order issued by Judge Carpio which directs for the immediate transport of Felonia in Quezon City RTC for his arraignment and presentation of evidence.
Sun.Star Davao earlier reported that DCPO director Vicente Danao Jr. said that they did not execute the order yet due to the unconfirmed venue.
Danao said the order issued by Carpio did not state the court in which Felonia shall be brought stating further that they could not risk bringing Felonia to Quezon City without knowing where to exactly deliver him.
Carpio pursued the arraignment of the other accused in the murder of King named Paul Dave Molina Labang and siblings Rommel and Rodel dela Cerna and ordered a not guilty plea in behalf of them last September 5.
Prior to that, the Supreme Court also sent a notice to RTC-Branch 16, containing an order that after the three accused are arraigned in Davao City, the case records will be forwarded to Quezon City-RTC for Felonia's arraignment and presentation of evidence.
