Suspected drug den operator, pals charged

A NOTORIOUS drug pusher and his four allies are facing charges before the court after they were found in possession of illegal drugs and drug paraphernalia in a raid last December 28, 2017, Thursday.

Charged with violation of the Republic Act 9165, otherwise known as The Comprehensive Dangerous Drugs Act, are Lucio Unggay, Belinda Unggay, Arnel Ungay, December Tipon Cortez, and Ina (name withheld for being a minor), 17.

According to the report of the PDEA-Davao, Lucio has been the subject of the search warrant no. 1929 earlier issued by Judge Evalyn Arellano-Morales of the Regional Trial Court (RTC) Branch 17.

The search warrant was implemented by the joint elements of the Philippine Drug Enforcement Agency agents in Davao City, Davao del Sur province, Davao Oriental, Davao Occidental, and interdiction units from Airport/Seaport.

Prosecutor Myla Comendador-Lao found probable cause to charge the accused based on the complaints filed by the members of the Philippine Drugs Enforcement Agency (PDEA) in Davao Region.

In a three-page resolution dated on January 15, two agents attested that a regular confidential informant appeared to the office and reported that Lucio is disposing and administering illegal drugs in Barangay 31-D in Mabini Boulevard.

A test buy where Lucio offered to the agent that he could use the shabu in his house. The agent declined saying his friends are waiting for him.

When the item bought tested positive for drugs, the PDEA applied for a search warrant and served this at 7 p.m. of December 28.

There were several who rushed out of Lucio's house and eluded arrest as the law enforcers arrived. But Lucio, December and Ina were held at the upper floor of the house, while Belinda and Arnel were held at the ground floor.

Recovered from the possession of the accused and from the house were six transparent plastic sachets of shabu, four P100 cash, one max staple box, and assorted drug paraphernalia.

Belinda and Arnel are siblings of Lucio, while December and Ina were allegedly visitors at the time when the raid was conducted.

Attached to the complaint is the assessment on discernment of the minor accused prepared by the Davao City Social Service and Development Office (CSSDO) which revealed that Ina acted with discernment in the commission of the crime.

The four accused is currently detained at the PDEA-Davao jail facility, while the CSSDO was directed to conduct the necessary diversion program for the minor.
