FOR issuing barangay certifications without authority from the village chief, Association of Barangay Councils (ABC) Cebu City President Philip Zafra filed administrative and criminal complaints against Tisa Barangay Councilor Eduardo Cabulao Jr.
Zafra, who is also Tisa barangay captain, lodged a complaint against Cabulao for violation of Article 177 (usurpation of official functions) of the Revised Penal Code, grave misconduct and conduct prejudicial to the best interest of the service before the Office of the Ombudsman.
While the complaint is pending, Zafra asked the anti-graft office to place Cabulao under preventive suspension to keep him from using his position to hide or tamper with any records.
Zafra, in his complaint affidavit, said that several certifications and endorsements were issued by Cabulao to the residents of Tisa from May 30, 2017 until June 5, 2017 without his authority.
Zafra invoked the Local Government Code, which provides that the power or authority to issue certifications and endorsements is vested in the barangay captain.
Zafra said that Cabulao’s father, Eduardo Cabulao Sr., heads the Barangay Mayor’s Office (BMO), whose creation he earlier questioned. Zafra previously requested the Department of Interior and Local Government 7 to look into the creation of the BMO to verify if these replicate functions of the barangay officials.
Sought for comment, Mayor Tomas Osmeña said he has the responsibility to see to it that every person will get fair treatment in the barangays.
“Many barangays simply do not want to serve the people who are not politically identified with them. They’re using a technicality, that they are the issuing authority, but I will defend that because as the mayor, I’m responsible for the city,” he said. (RVC)
