February 25 is special non-working holiday

THE “no work, no pay” policy shall take effect on Thursday, February 25, when the Philippines observes its 30th Edsa People Power Revolution that ousted the late dictator Ferdinand Marcos in 1986.

The Department of Labor and Employment (Dole) is reminding employers and employees of the Labor Advisory No. 01-2016, which states that workers, who will not go to work on February 25, a special non-working holiday, will not be entitled to any wages.

“Unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on special day,” the agency said.

Workers will get an additional 30 percent of their daily rate on the first eight hours of their work on the 25th or other special non-working holidays, or "daily rate x 130% plus cost of living allowance (COLA)".

Overtime work will be paid with an additional 30 percent of the hourly rate on the same day, or an "hourly rate of the basic daily wage x 130% x 130% x number of hours worked."

An employee who will work on February 25, which is his/her rest day, will be compensated with an additional 50 percent of his/her daily rate on the first eight hours of work, resulting in a "daily rate x 150% + COLA".

Overtime work done during a worker's rest day that falls on a holiday will be compensated with an hourly rate of the basic daily wage x 150% x 130% x number of hours worked.
