CA junks Menorca's amparo plea

THE Court of Appeals (CA) granted Tuesday the motion filed by officials of Iglesia ni Cristo (INC) to declare moot the petition for Amparo earlier filed against them by former INC member Lowell Menorca II.

In a 13-page resolution written by Associate Victoria Isabel Paredes, CA has dismissed the petition for writ of amparo filed by Menorca's camp against INC officials.

The CA 7th division declared it "moot and academic" as Menorca and his family had already left the country.

INC's lawyer Rogelio Vinluan earlier filed a motion to declare the petition moot and academic because Menorca consistently failed to attend the scheduled hearings.

Vinluan believed that Menorca's failure to attend the cross examination in CA indicates that he is not interested in pursuing the case anymore.

Menorca, together with his family flew to Ho Chi Minh City, Vietnam on the eve March 6 after disclosing on his Facebook account that his family received death threats.

Menorca's brother, Anthony, and his sister-in-law Jungko Otsuka filed the writ of Amparo petition before the court last October.

The petitioners claimed that Lowell, his wife Jinky, their daughter Yurie, were being held against their will by members of the Sanggunian, the INC's top administrative body.

The petitioners claimed that the INC was behind the abduction of Menorca as well as the alleged illegal detention committed against him last June. (Sunnex)
