Comelec to Marcos: Make formal request for poll system audit

COMMISSION on Elections (Comelec) commissioner Rowena Guanzon said Wednesday that Vice Presidential (VP) candidate Senator Ferdinand Marcos, Jr. must write a formal letter to the Comelec en banc if he wants a system audit of the Comelec transparency server.

"He can write us. Anybody can write us. They can write the en banc because anyway we are having our own audit. There are people preparing reports to congress," the commissioner said.

Guanzon added that since Marcos is still in office, he will also be able to get the copy of the Comelec report in the Congress.

The Comelec will also include on the report the tweaking in the script of the Comelec's server, she said.

"Probably, that will include the hash code because it is a fact. It has to be there. Aside from reporting to Congress, it will aid the commissioners on what problems and issues we experienced in this elections so that we can minimize the risk in the future elections," Guanzon said.

Election lawyer Romulo Macalintal in an interview said that Marcos' request to audit Comelec's system server only proves that his cheating allegations against the Comelec and now leading vice presidential candidate Leni Robredo were unfounded.

"Motion for system audit [ay] nagpapatunay na lang na walang katotohanan ang sinasabi ni Marcos na siya ay nadaya," Macalintal said.

The lawyer said that it appears as if Marcos is asking the Comelec to provide evidence that he was cheated.

"Parang sinasabi ni Marcos sa kasong ito na: Comelec, bigyan mo nga ako ng ebidensiya, Comelec can you develop my case?," Macalintal said.

He said that Marcos must present his evidence as Comelec will not develop a case nor help the senator prove that his allegations were true.

"He must present his evidence, he must rely on the strength of his evidence and not base on speculations or baseless accusations," Macalintal said.

He added that if Marcos would really maintain that he is cheated, he must show the election returns with discrepancies as that will serve as the strongest evidence in his claim.

"Para mapatunayan nila na may pandadaya, ihambing nila. E kung wala sila pinapakita at puro speculation lang na sinasabi bumaba ang kanilang boto hindi iyon ebidensya. Ang tunay na ebidensya ay kung ang kanilang authentic copy of the elections returns does not tally with the PPCRV," Macalintal said.

"'Yun ang magpapatunay, hindi pwede puro speculations, dapat hard evidence," he added. (Sunnex)
