Magpale, Daan take over Capitol

VICE Gov. Agnes Magpale is Cebu’s acting governor while PB Member Julian Daan becomes the acting vice governor from May 21 up to May 28 as Cebu Gov. Hilario Davide III is on vacation leave and is off to Osaka, Japan.

“You shall be acting governor during my temporary absence and shall, until my return on May 28, perform the duties and discharge the functions of the office of the governor,” read Davide’s May 20 letter to the vice governor.

Magpale, in return, also designated Daan as the acting vice governor and the Provincial Board member “shall perform the duties and functions of the Office of the Vice governor.”

Magpale’s authority, however, does not cover the appointing, suspending and dismissing of employees, and so does Daan’s.

The Local Government Code defines the power of the governor, among others, to appoint, suspend and dismiss Capitol employees, except the personnel of the Sanguniang Panlalawigan.

The vice governor is the appointing authority in the Sangguniang Panlalawigan.
