Court acquits Joavan Fernandez of direct assault

CEBU CITY -- Joavan Fernandez, who was sentenced to 50 years in prison on May 24 for illegal possession of firearms and explosive, was acquitted of direct assault raps Wednesday, May 25.

Municipal Trial Court in Cities Branch 6 Judge Pamela Baring-Uy said the decision was rendered as the prosecution failed to establish Fernandez's guilt.

The direct assault charge was filed against the accused by then Chief Inspector George Ylanan of the Cebu City Police Office’s Investigation and Detective Management Branch (IDMB) after Fernandez rammed into the IDMB patrol car three times.

The incident happened when the police were about to serve a warrant for Fernandez's arrest based on a malicious mischief case on February 6, 2011.

Fernandez is the adopted son of former Talisay City mayor Socrates Fernandez.

He walked out of the courtroom Wednesday after being acquitted. (With reports from Sun.Star Cebu/Sunnex)
