Man faces court trial for using fraudulent credit cards

THE Office of the Cebu City Prosecutor indicted a man who allegedly attempted to use two stolen credit cards in purchasing electronic gadgets inside a mall on May 3.

Assistant City Prosecutor Russel Busico found evidence to charge Jojie Eliseo Decena with two counts of attempted access device fraud and another two counts of violating the anti-alias law.

Decena’s indictment came after he failed to submit his counter-affidavit, which would have given him the chance to dispute the allegations against him.

The complainant, Candy Gimperoso, said she was on duty as cashier at the Macy’s Photo Store at the APM Mall in the North Reclamation Area, when a male, who was later identified as Decena, inquired about their gadgets on May 3.

Decena then told Gimperoso that he wanted to buy the gadgets he chose amounting to about P150, 000.

Decena asked the cashier to swipe his BDO (Banco de Oro) credit card, but the machine declined. He then gave his HSBC credit card and asked the cashier to swipe it, but the machine still declined the transactions.

Shortly, the cashier received a call from BDO personnel informing her that the BDO credit card that she swiped a while ago was a fraudulent one. That prompted the cashier to inform her employer, who immediately called for police assistance. The police later arrived and arrested Decena.

In the omnibus resolution, Prosecutor Busico said Decena may be held liable for violation of Republic Act 8484 for attempted access device fraud for using fraudulent credit cards.
