BACOLOD City Vice Mayor El Cid Familiaran said he believes the Commission on Elections (Comelec) will dismiss the recount petition filed by his opponent businessman Vladimir Gonzalez.
Familiaran, who attended the pre-trial conference held at Comelec Manila Tuesday, said on Thursday the legal counsel of Gonzalez failed to present the documentary evidence.
The conference was attended by Commissioners Luie Tito Guia, Arthur Lim, and Rowena Guanzon.
However, Guanzon chose to inhibit herself from tackling the case against Familiaran and Mayor Evelio Leonardia because she is also from Negros Occidental. Gonzalez, who failed to attend, was represented by his lawyer.
Defeated candidates of Pamilya Magbinuligay Kita Para sa Kauswagan (MKK) led by then Mayor Monico Puentevella and Gonzalez filed an electoral protest, with petition for manual recount, before the Comelec.
Familiaran’s pre-trial conference was separate from Leonardia’s recount protest hearing.
After the pre-trial conference, Familiaran said the Comelec will release the resolution after two or three weeks whether to dismiss or grant the recount petition.
“I am very confident that the Comelec will dismiss the recount petition for lack of valid grounds,” Familiaran said.
“When Gonzalez’s legal counsel was asked by the Comelec commissioners about the grounds for recount, fraud, and discrepancies, they failed to present the documentary evidence,” he said.
He added they will respect the decision of the Comelec.
