Dumaguete prosecutor dismisses OVY's complaint vs 3 children

THE Office of the City Prosecutor of Dumaguete City dismissed the trespassing complaint filed by Yanson family matriarch Olivia Yanson against her three children, Roy Yanson, Celina Yanson, and Ricardo V. Yanson Jr.

In a Resolution dated November 29, 2019, the three-man prosecution panel composed of Assistant City Prosecutors Andre Stephen G. Jacobo, Manolito T. Tiuseco and Milmon Bryce C. Tenorio found no probable cause to indict the three Yanson children for trespassing.

The prosecutors ruled out that “after careful evaluation of the evidence on record, the investigating panel is of the candid opinion that the instant complaint failed to establish probable cause against the respondents”.

They also found that Roy, Celina and Ricardo Jr. are co-owners of the estate subject of Olivia’s complaint by virtue of their being children of the complainant and the late Ricardo Yanson Sr., whose name of the said property is registered.

According to the investigating panel, “the existence of criminal intent, a crucial and very basic element of any felony, has been rendered unlikely by this ostensible right of the respondents to enter the property”. (TDE)
