A DRUNK man was arrested by police after allegedly firing his gun while having a drinking spree.
Mario Montemayor was arrested by responding police personnel of the Baguio City Police Office (BCPO) Station 3 in the evening of February 6 at No.122, Purok 6, Lower Navy Base, Brgy. St. Joseph, for violation of the Omnibus Election Code (gun ban) and grave threats on complaint of Augustina Saraan.
Based on Saran's complainant, she narrated the suspect fired his firearm towards the air after having a drinking session with his friends.
Responding police personnel and barangay officials proceeded to the suspect's house and surrendered a sling bag containing caliber .22 revolver, 51 pieces of caliber .45 ammunition and two pieces of empty 9mm shells.
He was was brought to Police Station 3 for proper disposition and inquest proceedings. Montemayor is the fifth violator of the gun ban in the region.
The Commission on Elections have earlier released the rules and regulations for gun ban and other prohibited acts during the election period.
The election period runs from January 13, up to June 12 and prohibits the bearing, carrying or transport firearms or other deadly weapons within this period.
Pursuant to Comelec Resolution No. 10446, however, qualified persons and entities may seek exemption to the gun ban and other prohibited acts by applying for the appropriate Certificate of Authority (CA) at the Comelec through the Committee on the Ban on Firearms and Security Personnel (CBFSP).
Application forms and requirements for the issuance of a CA must be submitted to the CBFSP Office at the Comelec Main Office from December 1, 2018 to May 29.
Unless properly covered by a CA, any permit to carry firearm/s outside one's residence or place of business will be ineffective and without force and effect during the Election Period.
During the election period, it is also prohibited to employ, avail or engage the services of security personnel or bodyguards. It is also prohibited to transport and deliver firearms and/or its parts, ammunition and/or its components, and explosives and/or its components unless duly authorized by the Comelec through the CBFSP.
Violation of these prohibited acts constitute election offense as provided under Section 261 of the Omnibus Election Code.
