

A DRAFT ordinance mandating safety protocols for outdoor recreational and tourism activities in Cebu City's mountain barangays has been filed in the City Council, following the fatal incident where a hiker died a Budlaan Falls.
The proposed measure, authored by City Councilor Dave Tumulak and endorsed to the Council on Tuesday, July 29, 2025, seeks to protect participants and promote responsible tourism across the city's upland areas and trekking zones.
The ordinance directly responds to the inherent risks of popular activities such as trekking, waterfall exploration, mountain biking, ATV riding, and cave exploration.
The recent tragedy at Budlaan Falls in Barangay Budlaan saw one hiker die and three others rescued after a strong water current, caused by a downpour, swept them away.
Under the proposed rules, all individuals and groups, including local and foreign tourists, must register with the respective barangays where activities occur.
Pre-activity weather assessments will become mandatory. These assessments will use information from DOST-Pagasa or verified local sources.
Safety briefings are a prerequisite for all participants. The ordinance also mandates the use of appropriate safety gear, including trekking shoes, life vests, and helmets. Littering and disturbing wildlife are strictly prohibited.
Newly established Barangay Enforcement and Monitoring Teams (BEMT) will primarily handle enforcement.
Violators will face penalties including P1,500 for first offense. Subsequent offenses can result in higher fines, imprisonment, and the cancellation or revocation of permits and licenses.
Barangays will receive a percentage of collected fees, providing an incentive for effective enforcement. (EHP)
