Ambush survivor wants policemen incarcerated

THE lone survivor in the ambush-slay of lawyer Noel Archival and two others wants the accused policemen jailed.

Paulo Cortes, assisted by his lawyer Rameses Villagonzalo, filed a motion asking Argao Regional Trial Court (RTC) Judge Maximo Perez to issue arrest warrants against Senior Supt. Romualdo Iglesia, Senior Insp. Joselito Lerion, and PO1 Alex Bacani.

They are facing multiple murder and frustrated murder cases before the Argao RTC.

Cortes was inside Archival's vehicle when the attack happened in Barangay Coro, Dalaguete last Feb. 18.

The other casualties are Candido Miñoza and Alejandro Jayme.

"The duty of the Honorable Court to issue the warrants of arrest is clear and mandatory. In no uncertain terms, it is bound by time (and by the duty of judicial exercise)," the motion read.

Section 5 of Rule 112 of the Revised Rules on Criminal Procedure states, "Within 10 days from the filing of the complaint or information, the judge shall personally

evaluate the resolution of the prosecutor and its supporting evidence."

The criminal cases against Iglesia, Lerion and Bacani were filed before Argao RTC last Sept. 25 yet.

Villagonzalo's fellow private prosecutors, Gloria Lastimosa-Dalawampu and Democrito Barcenas, filed a motion last Sept. 26 to issue the warrants against the three accused.

Dalawampu and Barcenas also asked Perez, in open court, to issue the arrest warrants last Nov. 27.

But Perez did not heed the prosecution.

The judge ordered the prosecution and the defense to submit their position papers on the motion for judicial determination of the probable cause on the filing of the cases against the three former members of the Highway Patrol Group 7 and the motions to suspend the issuance of arrest warrant.

The three have been assigned at the HPG headquarters pending resolution of their administrative cases.

The defense and prosecution were also told to comment on the defense's motion for reconsideration on the dismissed motion to quash the search warrant.
