GISAULOG karong adlawa ang Adlaw sa mga Minatay, ang paghandom niadtong atong mga minahal sa kinabuhi nga nipanaw na ngadto sa laing kalibotan.
Ginaingon man gud nga ning kalibotan duha ra ka butang ang segurado - ang buhis ug ang kamatayon. Gibuhisan ang tanan gawas na lang tingali sa hangin nga atong gihanggap.
Ang kamatayon mao ang hingpit nga katulugon kay ang namatay di na man matugaw sa mga daman ug mga damgo ug di na mapukaw pa.
Apan duna bay kaayohan nga ikadalit ang kamatayon? Tingali nakadungog na kita sa panultion nga kon mamatay ang tawo nga nangutang, impas ang iyang utang.
Ang Article 89 sa Revised Penal Code (RPC) of the Philippines nag-ingon nga ang kamatayon mopapas sa tulubagong kriminal sa usa ka tawo.
Mao kana nga idismiss ang kasong kriminal batok sa usa ka akusado nga namatay samtang gibista pa ang kaso. Mapapas usab ang tulubagong sibil nga nagsukad sa maong kasong kriminal kon namatay ang akusado human sa arraignment o pagbasa sa kaso ug gibista pa ang kaso o giapelar pa ang desisyon.
Apan magpadayon ug di maapektohan kadtong mga gitawag nga independent civil action.
Sumala pa sa Section 4, Rule 111, Revised Rules on Criminal Procedure:
“Section 4. Effect of death on civil actions. — The death of the accused after arraignment and during the pendency of the criminal action shall extinguish the civil liability arising from the delict. However, the independent civil action instituted under Section 3 of this Rule or which thereafter is instituted to enforce liability arising from other sources of obligation may be continued against the estate or legal representative of the accused after proper substitution or against said estate, as the case may be. The heirs of the accused may be substituted for the deceased without requiring the appointment of an executor or administrator and the court may appoint a guardian ad litem for the minor heirs."
“If the accused dies before arraignment, the case shall be dismissed without prejudice to any civil action the offended party may file against the estate of the deceased.” (edbarrita@gmail.com)
