THE Court of Appeals (CA) has affirmed the conviction of a police officer from Tuburan town, Cebu for mauling a man inside a karaoke bar in 2002.
The CA’s 18th Division upheld the lower court’s ruling convicting police officer Edsil Condevillamar of slight physical injuries.
“After a careful review of the records of this case, we see no reason to reverse or modify the findings of the trial court, especially because the Regional Trial Court has affirmed the same,” read the CA decision penned by Executive Justice Gabriel Ingles and with the concurrence of Associate Justices Pamela Ann Maxino and Renato Francisco.
The police officer was charged with less serious physical injuries for punching Enrique Gallardo inside the Seaview Music Lounge in Barangay Poblacion, Tuburan, Cebu on March 14, 2002.
Apart from Gallardo, the prosecution also presented as witnesses Susan Amon, Cristita Omandac, PO3 Mily Regulacion and Dr. Loreto Ong during trial.
In his testimony, Gallardo said he and his brother, Edilito, were in the bar when Condevillamar, who was reportedly tipsy, arrived.
Condevillamar allegedly slapped and boxed Gallardo without any provocation.
In his testimony, Condevillamar denied the charges, saying he responded to a “trouble alarm” in Barangay Poblacion but was boxed instead in the left eye.
Condevillamar said he inquired from bystanders about the identity of those who punched him. He later learned that Gallardo was the one who punched him.
On April 6, 2009, the trial court convicted Condevillamar of slight physical injuries and ordered to pay a fine of P5,000.
He was also ordered jailed for 15 days.
