THE Regional Trial Court (RTC) sentenced years of imprisonment to the couple, who were involved in the death of a three-year-old boy last August 24, 2016 in Matina Pangi, Davao City.
RTC Branch 54 Judge Ronald Tolentino on Thursday, March 9 sentenced six years and one day to eight years imprisonment to Grace Gilaga Agustin for being an accessory to the parricide while Sonny Boy Mendoza was sentenced 12 years and one day to four years imprisonment for the crime of homicide.
The original crime charged to the two accused were lowered from parricide to accessory to parricide and from murder to homicide after the judge approved the proposal to reduce the penalty proposed for the criminal charged, which was approved by the prosecution.
Agustin and Mendoza were charged for their alleged involvement in the death of Kean Gabriel Agustin, who died from bruises borne from alleged mauling of his stepfather.
The Davao City Prosecution Office filed the information against the two in the court last August 30, 2016.
The resolution stated that Agustin should be charged with parricide for she, who present at the time of the incident, allowed her son to be maltreated by her live-in partner.
Prosecutor Rogieliza Verallo, who issued the resolution, found an existence of conspiracy between the respondents.
Judge Tolentino also ordered the transfer of the couple from Maa City Jail to Davao Penal Colony located in Santo Tomas, Davao del Norte.
