CSC affirms Carbon reinstatement as GM

THE Civil Service Commission (CSC) Regional Office 6 has affirmed its decision reinstating lawyer Juliana Carbon as general manager of Bacolod City Water District (Baciwa) with modification that the appointment of Mario Macatangay as general manager dated December 1, 2015 is invalidated.

The September 26, 2016 ruling signed by CSC-6 Director IV Rodolfo Encajonado denied the motion for reconsideration of Baciwa filed through Dominador Isidro Jr. and Marlito Odosis, assistant government corporate counsel, and government corporate attorney, respectively, of the Office of the Government Corporate Counsel after they failed to offer any adequate argument to merit reversal of the decision sought to be reconsidered.

The CSC-6 granted the appeal of Carbon from her illegal termination and reinstated her as general manager of Baciwa with payment of back salaries starting August 18, 2015 until her actual reinstatement.

The decision also stated that the position of general manager of Baciwa is not vacant in view of Carbon’s reinstatement to the service and the appointment of Macatangay was issued in violation of the prohibition provided for in Section 5, Rule VII of the Omnibus Rules Implementing Book 4 of Executive Order No. 292, and Section 13 Rule XIII of CSC Memorandum Circular No. 40, series of 1998 as amended.

It further said that the appointment of Macatangay was only approved by the three members of the Baciwa Board namely David Villanueva, Alfredo Bayanin, and Ma. Aida Torre which was illegal and that Macatangay could no longer go back to his previous job with the Local Water Utilities Administration which has the oversight power over Baciwa.
