Lawyer: No moral, legal issue on same-sex marriage

THERE is no moral and legal issue on the implementation of the same sex marriage, a lawyer said.

Integrated Bar of the Philippines Governor of Eastern Mindanao lawyer Caesar Europa, in a media interview on Wednesday, said the legalization of same-sex marriage is not a problem as long as the parties involved are contributing members of the society.

"I do not see a wrong for it. In fact I would see a need for it on this day and age," Europa said.

Europa said that the biggest hold of the opposition in using laws as reference to stop the legalization of same-sex marriage is the definition of the family as the basic unit of the society.

Europa added that he could foresee that the legalization of same sex marriage would earn many opposition, especially from the church.

"One possible provision that they would use [to] oppose [its] legalization is the constitutional definition of the family as the basic unit of the society," Europa said.

However in his personal opinion, Europa sees the bill as an opportunity to address issues.

"We cannot deny that in the current situation, [there are] many members of the Lesbian, Gay, Bisexual, and Transgender community that are living together. They treat each other as man and wife and there is a need to also define the property relations and their duties and obligations to each other," Europa added.

Europa also said that it is not a secret that such conditions do exist in the modern society.

"Others say it is immoral, but for me, it is a matter of personal choice and for me, I could not say that they are immoral when they are not doing something destructive in the society," Europa added.

He said that whether it is traditional or same-sex marriage, the parties who are flaunting their relationships and having different sexual partners within marriage is closer to the definition of doing an immoral act.

"That is their personal decision and they are not doing anything detrimental to the society so why deny them the recognition of their union?" Europa said.

Europa added that just like any couples, conflicts between these unions are not inevitable and so as separation.

If couples want to separate, both would still refer to property rights.

House Speaker Pantaleon Alvarez recently manifested support to same-sex marriage and said that he is drafting a House Bill to push it. (KVC)
