Man accused of threatening lady boardmate

A MAN is facing charges before the court after he threatened to kill his boardmate at Coca-Cola Village on Mac Arthur Highway in Matina, Davao City, two weeks ago.

Charged with grave threats under the Revised Penal Code (RPC) is Carl Cedrick Lamaclamac, a temporary resident of Diamond Street at Coca-Cola Village in Matina.

In a resolution dated February 1, prosecutor Daniel Fernandez found probable cause to charge the accused based on the affidavit of complaint filed by Lynette Ciroy.

Ciroy said she was outside their rented apartment when she received a text message from her boardmate, Dannie Ross Lumantao, informing her that the accused and his girlfriend were fighting and she is among the reasons.

Ciroy said when she returned to the apartment, she saw the accused standing outside the door of the apartment, adding that she heard Lamaclamac saying, “Forgive me Father. I will kill someone. I will kill you Lynette,” in vernacular.

The alarmed complainant saw the accused armed with a kitchen knife so she opted to stay outside for safety. She waited for the accused to calm down before she entered.

The accused, however, chased her so she ran to their neighbors and asked them to call the police.

"This office pronounces that the act of the accused in uttering [those words] constitutes grave threats punishable of the RPC since killing is a crime and the threat was made without any condition," Fernandez said.

Fernandez said the act of the accused also constitutes grave threats under the RPC since it manifests his intent to kill, or at the very least, to inflict serious physical injuries, consistent with his earlier statement against the complainant. (ICT)
