A MAN is facing trespassing charges after breaking into a house at Bay View Village in Sasa, Davao City on April 24, Monday.
Charged with Qualified Trespass to Dwelling is Erick Magsino Pelipog.
In a resolution, prosecutor Faizal Padate found probable cause to charge the accused based on the complaint filed by Rufina Quiñequez, the homeowner.
Quiñequez said it was around 1 a.m. last April 24 when she heard a noise outside. She saw the accused cutting the chain that locks their gate and entered their house.
Quiñequez confronted the accused, who quickly left but returned soon after. That was when the complainant sought police assistance.
Padate said he found sufficient probable cause to charge the accused for entering the house of the complainant using force and against complainant's will.
Meanwhile, the earlier complaint for malicious mischief filed against the accused has been dismissed, considering that the same is absorbed in the charge for qualified trespass to dwelling.
