Motion filed vs ex-Baguio lawmaker, 3 others

BAGUIO Water District (BWD) general manager Salvador Royeca confirmed a motion for reconsideration was filed against the decision of Pollution Adjudication Board (PAB) to fine a former Baguio Representative and three others for violating Clean Water Act.

The BWD is contesting the PAB decision to fine Nicasio Aliping and contractors Romeo Aquino of RUA Construction, William Go of Goldrich Construction, and Bernard Capuyan of BLC Construction and Aggregates with P200,000.

The motion was filed in April, shortly after the PAB ruling.

The 2016 case stemmed from the road project of Aliping and three contractors. The project was blamed for the massive landslides, which were aggravated by the rains, sediments and rocks continuously slide down, causing contamination of the Amliang dams, a water source of BWD to supply residents of Baguio City and Tuba town.

Royeca said the turbidity, which measures the clarity of a liquid, at the Sto. Tomas has been normalized after suffering from heavy turbidity years ago.

Royeca added the case is being handled by the BWD legal team headed by Ma. Tarjata Arevallo-Manaois.

Aliping also faces violations on illegal cutting, removing, gathering or collecting timber from a forest reservation, and unlawful occupation and destruction of forest and grazing lands.

The separate case was filed by the Department of Environment and Natural Resources.

In 2015 former Baguio-Benguet Bishop Caarlito Cenzon with Archbishop Socrates Villegas of the Lingayen-Dagupan Diocese led the filing of a Writ of Kalikasan to stop activities on the mountain in a bid to stop its deterioration, a Temporary Environment Protection Order (TEPO) to stop road openings and other developments being undertaken at Mount Sto. Tomas watershed.
