Overlapping titles spark South Drive conflict

A RESURVEY of properties along South Drive is being proposed to determine ownership of now contested lots.

Months ago, the local council was alarmed by the danger of the Eusebio Aquino nine story building has caused the city owned road as well as the private property of the Calinao family, adjacent the Aquino owned lot.

After Aquino’s construction team, EBA, repaired damages to the city owned road, land woes now plague the neighboring Calinao property with overlapping landtitles.

Councilor Edgar Avila, chair for the committee on lands now handles the land woes along South Drive.

“The committee solution is to determine the meets and bounds of the property through survey based on the technical description in their titles, awards and tax declarations.”

Avila said he is urging the Calinao’s to agree to the re–survey.

“They should, if they want a final solution, pag-ayaw, we will just refer the matter to the courts,” added Avila.

Avila said boundary disputes of titled properties are within the realm of the courts but since “we are lands and urban planning, we can cognizance the issues to settle the problem.”

“There is a need for a resurvey by three surveyors composed of the Calinao surveyor, the Aquino surveryor with the DENR surveyor as chairman,” Avila added.

The lawmaker said after the survey, the parties must agree to respect the findings “so that once and for all we can put an end to the issue.”

The Aquino building has six floors dedicated to a hotel while the remaining floors will serve as parking spaces, construction has encroached on the South Drive road as well as affected the nearby Calinao property.

Councilor Leandoro Yangot after an inspection months ago said private property owners, the Calinao clan, is being pressured to sell their area to Aquino, developer of the neighboring nine storey building.

Yangot said the issue being faced now is conflicting lot plans issued by the Department of Environment and Natural Resources to Aquino which now show ownership over the Calinao property.

During the inspection parts of the Calinao home showed to be sinking, left unrepaired and rehabilitated by Aquino despite promises made in the past.

The damages inflicted in the area has been reported by the village chief since 2016 but left unanswered.

Yangot said another neighbor whose property has also sunk because of the Aquino construction was forced to sell.
