THE City Environment and Natural Resources (Cenro) in Bacolod City has called the attention of businessman Rey Francis Cabuga to initiate steps appropriate to the situation in the development of his beach resort in Barangay Punta Taytay.
Joan Nathaniel Gerangaya, OIC Cenro-Bacolod, and Freddie Bata-anon, deputy public land inspector of Cenro, who investigated the said project last April 7, confirmed that the owner has not obtained the necessary permits from various government agencies.
They said what they had was a resolution of no objection from the Barangay Council of Punta Taytay necessary for its application on foreshore lease agreement (FLA) on the condition that they will provide a three-meter right of way to allow the public to gain access to and coming from the sea shore.
Cabuga has constructed a two-storey building, two units of swimming pools for adults and kids, and other significant recreational facilities.
Also evident in the area are 10 units of native rest houses. The development is being done simultaneously and is almost 80 percent finished despite the lack of permits as noted by the Cenro-Bacolod officials.
Cabuga, who represents the Mushroom Realty Development Corp., does not have a permit or tenurial instrument that would allow his development within the area of his FLA-064501-133, the Cenro investigation showed.
He applied for an FLA for his beach resort covering 1,303 square meters of parcel of public land adjoining his titled property.
The application was referred to the Department of Public Works and Highways Bacolod Engineering District, City Engineer's Office, Philippine Ports Authority and the Barangay Council of Punta Taytay. (CNC)
