Capil disappointed over Comelec DQ ruling, files MR

Reelected Porac Mayor Jing Capil has expressed disappointment over the decision of the Commission on Elections (Comelec) Second Division disqualifying him in the May 12, 2025 National and Local Elections.

The mayor called the Comelec ruling "unexpected and premature."

Capil said the disqualification was based on a case still pending before the Ombudsman, which is not yet final as their Motion for Reconsideration (MR) is still being heard.

He questioned why the Comelec would issue a decision despite what he called a lack of finality in the case.

“Labis na ikinagulat namin ang naging desisyon na ito ng Second Division ng Comelec,” Capil said, pointing out that the Supreme Court had earlier issued a Temporary Restraining Order (TRO) that allows candidates with pending disqualification cases to run and serve, provided no final ruling has been issued.

Capil added that the Comelec’s own Resolution No. 11044-A, which disqualifies candidates with DQ cases, had its implementation suspended because of the TRO.

“Malinaw po ang naging hatol at mandato ng Poraqueños,” he said.

The mayor asserted that he was already proclaimed by the Comelec as the duly elected mayor of Porac on May 12, 2025.

To challenge the Comelec ruling, Capil said he filed a motion for reconsideration before the Comelec main office in Intramuros, Manila, on May 30.

He said this legal action is aimed to defend not only his right to serve but also the decision of the electorate who voted for him.

“Through this Motion for Reconsideration and all available legal remedies, isusulong po natin ang ating karapatan bilang halal na mayor ng Porac,” he said.

Capil also revealed that he and Councilors Jovy Venzon and Papay Carreon took their oath of office on May 22, 2025, before ABC President and Councilor Joel Capil.

Capil called on his supporters to remain calm and to trust in the legal process. “Samahan nyo po ako manalangin na ang aming mga legal arguments ay dinggin.”
