
The Supreme Court (SC) has affirmed the dismissal of graft and malversation charges filed against former Mexico Mayor Teddy Tumang and businessman William Colis.
The SC ruled that their right to a speedy resolution of cases filed against them was violated because of delays in the investigation.
The case was based on claims that from 2006 to 2007, Tumang improperly approved payments to Colis’s company, Buyu Trading and Construction, for construction materials.
The Supreme Court upheld the Sandiganbayan’s decision to dismiss the case, stating that the lengthy investigation harmed Tumang and Colis’ ability to defend themselves.
The SC also clarified that dropping the charges is the same as an acquittal, meaning the case cannot be reopened due to the rule against double jeopardy.
