Temporaryo nga gipahunong sa Court of Appeals (CA) ang Bureau of Animal Industry (BAI) sa Department of Agriculture (DA) sa pagpatuman sa polisiya sa culling ug zoning map alang sa pagpugong sa African swine fever (ASF) sa Probinsiya sa Sugbo.
Sa resolusyon nga pinetsahan niadtong Biyernes, Hunyo 30, 2023, ang 20th Division sa CA sa dakbayan sa Sugbo niingon nga adunay dinalian nga pagluwat sa temporary restraining order (TRO).
Nakita sa CA nga makatarunganon ang pag-isyu sa TRO, nga nag-ingon nga “the continued implementation of the culling and zoning policy of respondent will cause grave and irreparable damage” sa probinsya.
“The Province of Cebu before the declaration of respondent of the existence of ASF in the province, [had] been one of the biggest suppliers of hogs and meat products in the country,” it said. “The culling and zoning map policy of respondent gravely affected the P11-billion hog industry in the province, which if not abated will cause irreparable damage not just to the livelihood of the constituents but more importantly to the economic growth and sustainability of the hog industry in the Province of Cebu.”
“There appears, at least preliminarily, a right on the part of petitioner that needs to be protected. Aside from the property rights and general welfare of its constituents, the right to local autonomy of petitioner is being threatened by the refusal of respondent to properly coordinate and cooperate with the LGU,” kini nidugang.

Si Gobernador Gwendolyn Garcia nihimo og press conference niadtong Biyernes sa hapon aron ipahibalo ang pag-isyu sa CA sa TRO, sulod sa 60 ka adlaw gikan sa pahibalo.
Nanawagan siya sa ubang local government units (LGUs) nga tangtangon ang ilang kasamtangang mga polisiya nga nagdili sa importasyon sa mga buhing baboy ug mga produkto gikan sa Sugbo base sa resolusyon sa CA.
“They will have to recognize that there is no reason to prohibit the shipment of our hogs or pigs,” matod ni Garcia sa press conference, nga gi-livestream sa Sugbo News’ Facebook page.
Ang gobernador niingon nga nisang-at sila og petition for prohibition batok sa BAI niadtong Abril 18, nga nag-awhag sa CA nga hunongon ang ASF policy niini sa probinsiya.
Ang petisyon usa ka espesyal nga aksyong sibil nga nangita alang sa usa ka hukom nga nagmando sa respondent sa paghunong sa pagpadayon sa paghimo sa usa ka buhat nga gituohan nga ilegal.
Kinahanglan pa nga hukman sa CA ang petisyon.
Ang Kagamhanan sa Probinsiya nipasaka usab og kaso batok sa mga opisyal sa BAI atubangan sa Office of the Ombudsman.

Gikutlo usab sa CA ang pamahayag ni DA 7 Director Angel Enriquez, kinsa miila sa posibilidad sa reevaluate sa kasamtangang ASF protocols sa BAI.
“Since a re-evaluation and review of such protocols is not yet forthcoming, it is urgent that a TRO be issued to suspend temporarily the culling and zoning policy of respondent in the Province of Cebu, pendíng hearing on the application for a writ of preliminary injunction.
