ANG Commission on Audit (COA) usa sa tulo ka mga independente nga constitutional commissions ubos sa Article IX sa 1987 Constitution, uban sa Civil Service Commission (CSC) ug Commission on Elections (Comelec). Kay independente man, di sila ubos sa executive, legislative ug judicial branches sa gobyerno.
Gihatag sa Konstitusyon ngadto sa COA ang gahom, awtoridad ug katungdanan sa pag-examine, pag-audit, ug pag-settle sa tanang accounts sa tanang salapi nga madawat, mga resibo ug paggasto sa pundo ug paggamit sa mga kabtangan sa tanang mga ahensiya sa gobyerno.
Niining bag-o, naukay ang katawhan sa 2020 audit report sa COA nga nagyagyag sa mga deficiencies, sa mga pagkuwang sa Department of Health (DOH), sa paggamit sa P67.32 ka bilyon nga pundo alang sa Covid-19 pandemic. Nakuykuyan pa sa COA ang P11.89 ka bilyon nga wa magasto sa DOH sa 2020.
Matod pa sa editorial sa Philippine Daily Inquirer, “The news was like a fresh lash on an already prone, much-flogged country.” Ang maong balita sama sa lab-as nga labhag sa nasod nga naigo sa daghang latos sa latigo ug nahapla na. Gitawag sa COA ang mga sayop sa DOH nga “missed opportunities.’’
Apan ang Makabayan bloc sa mga magbabalaod miingon nga ang gibuhat sa DOH mao ang “grave inefficiency, gross incompetence, and criminal negligence.” Gipasaka nila ang House Resolution No. 2129 nga nag-awhag sa House committees on public accounts ug good government and public accountability sa pag-imbestigar sa DOH.
“The inefficiency, delay and the incompetence in the delivery of the much-needed services to the public already amount to criminal negligence as thousands of Filipinos already died and are dying of getting infected of the viral disease,” matod pa sa resolusyon.
Unsa man kining criminal negligence? Mao kini ang reckless imprudence nga gisilotan ubos sa Revised Penal Code (RPC). Ang Article 365, RPC (as amended by Republic Act No. 1790), nag-define sa reckless imprudence.
Nagkanayon kini, “Reckless imprudence consists in voluntarily, but without malice, doing or failing to do an act from which material damage results by reason of inexcusable lack of precaution on the part of the person performing or failing to perform such act, taking into consideration his employment or occupation, degree of intelligence, physical condition and other circumstances regarding persons, time and place.”
Mao kini ang boluntaryo nga pagbuhat apan sa way malisya, ingon man sa wala pagbuhat sa angay buhaton nga niresulta sa kadaot sa laing tawo tungod sa kakuwang sa panagana ug pag-amping.
