BAGUIO City Mayor Maurico Domogan is ready to answer Commission on Human Rights against allegations hurled by Roger Sinot in relation to the Asin land dispute.

Domogan stood pat on his stand that the pools are part of the property of the city and held on to court decisions favoring the local government on the installation of fences and padlocks.

The mayor said the city will respond to the CHR report when it is asked, adding that there is no stopping complainant Sinot from writing the agency.

This week, Sinot wrote CHR regional director Rommel Daguimol to ask for immediate assistance in resolving what he believes is a violation of human rights by the city government for padlocking entrances in the contested Asin property.

Sinot implored to the CHR assistance to what he described as “inhuman and oppressive acts of the city government of Baguio in the implementation of a court decision in an unlawful detainer case.”

The mayor said the city has won all court cases and is merely implementing its decisions.

The resort sits on a 4,344.23-square-meter property of the city which was leased to spouses Catbagan for 20 years or until 1996. Catbagan sub-leased it to former manager Roger Sinot sometime in 1993.

On June 3, 2002, Sinot entered into a contract of lease with the city government for 15 years with a monthly rental of P3,000. The contract of lease was not confirmed by the City Council while the Supreme Court Decision No. G.R. 204667 dated June 10, 2013 affirming the Court of Appeals (CA) Decision and Resolution in CA-G.R. SP 121692 ordering Sinot to immediately vacate the Asin Hot Spring Resort and pay P5,000 monthly rental for the use and occupation thereof from December 1996 until he have finally vacated the same.

Sinot, in his letter to the CHR, said the city government on November 29 sent workers to install a concrete fence on the very entrance for his abode ‘Thus detaining and imprisoning those left at home and our customers who were then enjoying dipping their bodies in the hot bath tub. The first gate to his property was also padlocked to ensure no one could get out.

Sinot is also complaining over acts of the Public Order and Safety Division that installed the fence and barricade, saying it is unlawful and has sowed fear among the people in his Asin property.
