TWO brothers from Talisay City, Cebu could face up to 14 years in jail for stabbing to death their neighbor in 2009.

The Supreme Court downgraded the conviction of brothers Michael and Allan Delima from murder to homicide for the death of Ramel Congreso last June 13, 2009.

“There are no aggravating circumstances against accused or mitigating circumstances in their favor,” read the CA decision penned by Associate Justice Samuel Martires.

The Delima brothers and three others reportedly ganged up on Congreso during a fiesta celebration in Barangay Poblacion, Talisay City.

In their testimony, the Delima brothers said they were inside their house when the stabbing incident occurred.

The lower court sentenced the convicts to reclusion perpetua or 20 to 40 years in jail. The judge also ordered them to pay the victim’s heirs P50,000 as civil indemnity; P150,000 as moral damages, and P125,000 as temperate damages. (GMD)
