Dole 7: More pay for workers who render duty on Nov. 1, 2

THE Department of Labor and Employment (Dole) 7 has reminded employers that workers who report to work on Nov. 1 and 2—All Saints’ and All Souls’ days—should get more pay.

The two dates were declared special non-working holidays.

According to Dole 7 Director Salome Siaton, for work done during a special day, workers must be paid an additional 30 percent of their basic daily wage on the first eight hours of work.

She cautioned employers to be extra careful in the computation of wages on said days, especially if workers are asked to render overtime work.

For work done in excess of eight hours, Siaton said workers should be paid an additional 30 percent of their hourly rate on said day.

“The computation of the hourly rate should be based this time on the rate earned by the worker on said day which is 130 percent of his or her daily rate,” she said.

If Nov. 1 and 2 happen to be the workers’ rest days, and yet they report to work, they must be paid an additional 50 percent of their basic wage on the first eight hours of work.

Also, for work done in excess of eight hours during a special day that also falls on workers’ rest day, they should be paid an additional 30 percent of their hourly rate on the said day.

“We would just like to emphasize that daily paid workers would not be compensated on Nov. 1 and 2 if they would not work on said days,” she said.

The general principle of no work, no pay will apply, said Siaton.

“However, if there is an existing company policy or practice that workers are paid on special non-working days or if there is a provision stipulated in the Collective Bargaining Agreement for unionized companies that workers are paid on special days, then workers will be paid even if they won’t report to work,” she said.

Siaton said monthly-paid workers would also be paid even if they will not work on a special non-working holiday. These are those who are paid every day of the month, including unworked rest days, special days, and regular holidays. CSL
