Marcos camp to file criminal rap vs Smartmatic exec

THE camp of vice presidential candidate Senator Ferdinand Marcos Jr. is set to file a criminal complaint against an executive of poll service provider Smartmatic for the alleged unauthorized script tweak in the Commission on Elections (Comelec) transparency server.

Jonathan dela Cruz, Marcos' campaign adviser, said they will file a case against Smartmatic manager Marlon Garcia before the Comelec on Friday.

Dela Cruz said Garcia, who changed the script, allegedly violated Section 28 of the Automated Election System Law.

Section 28 of the Automated Election System Law prohibits acts that include "interfering with, impeding, absconding for purpose of gain, preventing the installation or use of computer counting devices and the processing, storage, generation and transmission of election results, data or information."

"We don't want this Venezuelan to get away with it," Dela Cruz said, noting that Garcia was once charged for a similar offense in connection with the 2013 elections.

Meanwhile, lawyer Jose Amor Amorado, Marcos head of his Quick-Count Center, said they will also submit a new letter to gain access to the transmission logs, list of vote counting machines, USB devices and Broadband Global Area Network used in the polls, and the public key and decryption key to open up the transmission files.

"This will enable us to explain, and we would be able to see, how many were the undervotes, which is critical to the count of the votes for the vice presidential position," Amorado said.

As of Thursday, Amorado said that based on their own count, there were around 3.5 million undervotes for the said position, "which is unusual because this position was hotly-contested in this election."

Marcos camp also lamented the cancellation of the scheduled hearing of the Joint Congressional Oversight Committee on the Automated Election System because of the absence of Smartmatic officials. (Sunnex)
