THE Department of Labor and Employment (Dole) released Tuesday, October 26, 2021, the pay guidelines for the special (non-working) day on November 1 and the regular holiday on November 30, 2021.

In Labor Advisory No. 19 Series of 2021 issued by Labor Acting Secretary Atty. Ana C. Dione, employers are reminded to observe the proper payment rules during the observance of All Saints' Day 1 and Bonifacio Day on November 30, 2021.

Employees working during the Special (Non-Working) Day on November 1 shall be paid an additional 30 percent of their daily rate on the first eight hours of work (Basic wage x 130 percent) plus Cola.

For work done in excess of eight hours, the employee shall be paid 30 percent of his/her hourly rate. (Hourly rate of the basic wage x 130 percent x 130 percent x number of hours worked).

For work done during a special day that also falls on the workers’ rest day, the employee shall be paid an additional 50 percent of their daily rate on the first eight hours of work.

For work done in excess of eight hours during a special day that also falls on the workers’ rest day, they shall be paid an additional 30 percent of their hourly rate on said day, or a computation of hourly rate of the basic daily wage x 150 percent x 130 percent x number of hours worked.

But for workers not working on November 1, the "no work, no pay" principle shall apply, unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.

Workers who do not work on November 30, a regular holiday (Bonifacio Day), will be paid 100 percent of their daily wage.

Employees who work on the regular holiday, on the other hand, will be paid 200 percent of their daily rate for the first eight hours.

Working overtime on the regular holiday, he/she shall be paid an additional 30 percent of his/her hourly rate on said day.

Working on a regular holiday that is also the employee's rest day, he/she shall be paid an additional 30 percent of his/her daily rate of 200 percent.

Under the advisory, Dole however, said that companies that have totally closed operations during the community quarantine period are exempted from the payment of the November 30, 2021 holiday pay. (MVG with PR)
