CH files case to reclaim ownership of landfill lot

THE Cebu City Government will continue any development that will be implemented at the Inayawan Sanitary Landfill despite the ownership status of the lot.

Francisco “Bimbo” Fernandez, executive assistant of Mayor Tomas Osmeña, said that since the City had been in possession of the property for years, then it was the rightful owner of the lot.

“It (the lot where the landfill is) was titled in 1972 and we just learned about it. We learned about it when the private owner applied for a new tax declaration before the City Assessor’s Office,” he said.

Fernandez said the City filed an adverse claim on the ownership of the lot and asked the Office of the Solicitor General to file a revision case.

The objective of an action for reversion of public land, according to sc.judiciary.gov.ph, is the cancellation of the certificate of title and the resulting reversion of the land covered by the title to the State.

“We will work for the cancellation of the title. Our allegation is that the title was fake and it was illegally acquired,” Fernandez said.

Based on records, the 15-hectare landfill was part of a 28-hectare titled property under the name of Renato Senining, a city resident.

Fernandez said the titled lot was about to be transferred to Golden Hectarage Corp., the property’s new owner.

In the meantime, Full Advantage Philippines International Inc. is about to close and rehabilitate the landfill, two years after the facility stopped operations.
