Benguet official sued over ‘shouting’ episode

A CASE of unjust vexation was filed against a La Trinidad official after shouting against a zoning officer over the release of an excavation permit.

Emerson Taberno, La Trinidad Municipal zoning officer, said Councilor Nestor Fongwan Jr., embarrassed and humiliated him on March 27, during the council session.

Taberno, in an affidavit filed to the La Trinidad Municipal Police Station, he said he was at the council session to answer queries regarding the communal forest from local officials.

Taberno however was surprised and embarrassed when Fongwan Jr. asked him about the status of the excavation permit of a certain James Benos in an angry manner.

Fongwan Jr. allegedly shouted unsavory words against him while slamming his fist on the table.

Taberno said Fongwan was telling him that his office has not acted on the application of those applying for an excavation permit.

Fongwan, who is also the Provincial Board Member of Benguet asked Tabernero not to use his name and the municipal council, in any way, in collecting money from the excavation permit.

"Please tell them the truth - your office have not yet submitted a Citizens Charter. Our developers are now informed they need a permit for excavation. But please don’t tell them I am the one banning them,” added Fongwan in the local dialect.
