Cabbie sued for trisikad rider's death

A TAXI driver is facing charges after he bumped a trisikad (cycle rickshaw) in Leon Garcia Street, Davao City last December.

Marjun Mapa Cabal, a driver of the Premier Taxi, was charged with reckless imprudence resulting to homicide, multiple serious physical injuries, and damage to property.

In a resolution dated January 23, prosecutor Rogieliza Verallo found probable cause to charge the accused based on the affidavit complaint filed by a family member of the victims Eduardo, Leonora, and Eldrin Monsale.

According to the complainant Eddie, his father was driving the trisikad on Leon Garcia Street, with his mother and brother on board when the taxi bumped them. Leonora died while Eduardo and Eldrin were seriously injured.

The Traffic Accident Investigation Report (Tair) stated the taxi was traveling too fast.

The Tair blamed the collision and death to the speed by which the driver was going.

Verallo said the accused is liable under article 365 of the Revised Penal Code. (ICT)
