Local court junks case vs Franzkate, Interchemez

A LOCAL court in Bacolod City dismissed the civil case against Franzkate Marketing and Interchemez Laboratories Inc. as it has no jurisdiction over the case.

Franzkate Marketing was owned by Catherine Cabuga while estranged husband, Francis Rey Cabuga, represented Health First Wellness Laboratories Inc., the complainant of the case.

Bacolod City Regional Trial Court Branch 54 Judge Eduardo Sayson, in his order dated October 23, stressed this court is a court of general jurisdiction cannot take cognizance of the case which falls under the exclusive jurisdiction of the designated Special Commercial Court. Therefore, it cannot lawfully exercise jurisdiction over the case. Foregoing considered, let this case be dismissed without prejudiced.”

This came after the complainant alleged that their company is the registered owner of the brand name Koi with a product registered in Food and Drug Administration as Herbal Dietary Supplement Capsule while Franzkate Marketing was previously listed as the distributor and marketing arm of the brand name Koi.

The complainant claimed that Franzkate is no longer the distributor of Koi Herbal Dietary Food Supplement thus Koi was infringed by Interchemex Laboratories Inc. and Franzkate Marketing.

Meanwhile, Catherine Cabuga said they destroyed her business which they put up many years ago.

“They never succeeded in their ploy against me. I will fight for my right and for my children. This is my birthday gift to my estranged husband Francis Rey,” she said.
